As I was backing out I saw a car just turning in from to street in to the driveway. I was at Quiktrip. And the car was far away so as i was backing out, I suddenly hit it. I had no idea where it came from. the people there said that the car was far away and they should have stop, but instead the came up behind me and I hit them. They seemed kinda fine if not a little scared, as though they meant for It 2 happen. I was fully ou tof my parking space when this happened. I gave them my insurance information, but the fail 2 give me theres. They said that they have 2 get their boss over, (cuz I hit a company car). When the boss arrived, I as for insurance info, but they told me to call the company 2morow 2 ask for it, as they did not have it with them. Anyways all I got was their license tag and their names. What shoudl I do and whoses fault is it? I think it's mine, but everyone says that it's theirs.

  1. I hope a police report was made.  Now you need to notify Your insurance company and let them handle the whole matter.  That is what you have insurance for.  Altho, it sounds as if it was your fault (unsafe backing)  Don't worry about "Fault"  That is not for you to determine anyway.  Let the 2 insurance companies work it out

  2. In an accident, NEVER admit to fault.  That will get you into trouble quicker than anything.  If you did not report this to the police, you must do so immediately.  Don't worry about trouble.  Right now you are covering yourself.  I hope you got the names and phone numbers of the people who saw the accident.  They will be your best defense.  I place no blame on either party.  Just let someone know.  That he manager didn't have any info about the insurance seems a little 'hinky' to me.

  3. It is your fault, but because you were backing into a street.  The car you hit had the right of way

  4. First of all, do not admit who's fault it was. You were already backed out and in drive?

This happened to me when I was already backed out and he backed out and hit me, and his insurance paid the damages. As for the insurance information, if you have the name of the company they have insurance with, call them up and speak to claims and tell them what is going on. Also, find out if they called yours and what they said happened.

    Good luck!

  5. if they saw u and they were a good distance away, they should've stopped to let u go so obviously they are in the wrong.

  6. Never admit fault at an accident unless it was CLEARLY your fault.

I would call your insurance company first, tell them what happened and they will instruct you on what to do next.  They don't want to pay, so if it wasn't your fault they will help you get the other people to pay.

I hope you have witnesses, because you may need them.  Next time, if there is damage to the cars, you should call the police.

  7. Good advice previously posted...don't ever admit fault...just give state required information....if serious, be sure police are called....

Don't get me wrong but your story is sort of funny.....

you say, " I saw a car" and then "I had no idea where it came from."  "It was far away" and "I suddenly hit it".... how far away and how long does it take to pull out of a space?

They had a company car?  All company car must have a certificate of insurance in the car at all times. (In this state, at least).

There are several websites where you can read accident reports and the statements people make after having an accident.  These are quite funny and sometimes downright hilarious.  Check these out....
