Hi! My friend was deported 7 years ago because he was living in california with a visitors visa.?

He could come and go in the us but not live, go to school, etc. He lived in california for 3 years staight. He went on a trip outside the us and when he came back he was not allowed to go out of the airport because they found out he lived here for 3 years straight and was deported. This happened 7 years ago. Can he still apply for a visa? What kind of visa can he apply for? How long does he have to wait? Or, is it very likely that they wont give him a visa? Are there any visas that would be easier for him to get? Thank you all for your help and time!

  1. Since he stayed for three years out of status in the US, he is barred for ten years under the Immigration and Nationality Act, Section 212(a)(9)(b)(II).  Although he could in theory apply for another nonimmigrant visa, a waiver would be required and he is very unlikely to qualify.  Even if he could apply for an immigrant visa, he would probably not get the waiver and would have to wait another three years.


  2. since he was deported, the usual is 10 years forbidden entry,he has to wait until the 10 years is passed.

  3. Apply for a tourist visa.
