Hi !! My greencard is expired for the past 2 years and i´m overseas can i enter the U.S this way ???

Due to personal problems my residence card well most known like the ( greencard ) has expired it´s been about close to 2 years, Right now i live in europe, but i was born in mexico and i want to go back. Can anyone tell me what i can do ?? any information will be apreciated. Thank You.

  1. Well, you can certainly contact the US embassy in the country where you live, but it's very unlikely to do you much good. You don't mention what your personal problems were, but if you think you were unable to return due to circumstances beyond your control, you could at least try to apply for a returning resident visa. It would be up to the embassy people to decide if you can even apply, and you would have to document whatever your reasons were for not returning within a year, so I don't hold out much chance of success, but it is at least a possibility. Otherwise, you would have to requalify for immigrant status again, if that's possible for you. as I imagine you know, the waiting periods for Mexican citizens in most immigrant categories is quite long.


  2. Best thing to do is to contact the American Embassy in your country. My feeling is if you have been out of the US for over a year and have not paid taxes then you will have a very difficult time entering the US as a permanent resident.

  3. Did you apply for a reentry permit? as your stay was over 6 months? The immigration officers will probably deny you entry on it. There are guidelines that as a green card holder you must stick to and those include living out of the country and what you must do to maintain the status of a green card. Not only has your card expired you have been out of the country two years. Going on what you are saying your green card status is no longer valid.

  5. Chances are good you will be arrested upon entering USA. Expired greencard makes you an Illegal Alien.

    Since you are a Mexican CITIZEN, go directly to Mexico and fix things from there. Rules are rules and personal problems are NOT a factor in determining legality.
