Question:

Highway Patrol scratched my car's paintjob can i sue them?

my can broke down in the freeway and the highway patrol pushed my car using theirs to a gas station to wait for a tow truck and didnt notice the scratched paintjob till it got home. do i have the right to sue them to compensate for what they did?

btw i forgot the officer's name

  1. Do you have a videotape of the incident? Do you have proof that the damage was caused by the officer, and that it wasn't there before? Did the officer acknowledge, in writing, that he caused the damage? Do you have witnesses? Otherwise, you can forget it.


  2. You could sue, but it would be a waste of your money. He could have given you a ticket for blocking traffic. They have those push bars on their cars so they can keep the freeways from backing up. Think of it this way, you could have been hit by another car or even a semi, instead you got a little scratched paint.

    You big baby -- these guys were trying to get your heap off the road to avoid a pile-up and you're crying about a scratched bumper? Police officers, even the ones that issue speeding tickets, have the most nightmarish job on the planet; everyone hates them, they put their life on the line every single day and get zero respect. yet, they are the first people you call if someone is trying to hurt you or your family, someone steals your precious automobile or you spot a drunk weaving down the freeway at 100 mph. YOU sure as h**l won't stop him but you expect the cops to do it at their own peril. At the very least contact their office and ask for the captain then explain the situation. They probably have insurance for this (though you should be ashamed to even ask...)

  4. Did he just start pushing your car with his without telling you? If so, maybe. More than likely, he told you he was going to do it, so you basically gave him permission to do it, so that clears him.

    Also, you were impeding traffic, so he could have ticketed you, or called a tow truck, and you would have had to pay a lot more for that.

    How old is your car? If its more than 5 years old, it probably has more scratches on it, than what he put on your car.

You can try suing them but you won't will.  First off, you're blocking and obstructing traffic which can be ticketed but didn't.  He is a peace officer who does his job of moving your car and removing you/the public from harm therefore he is not liable unless he ram your car going 50mph to move it off the street but if he did it in 5-15mph then you're out of luck.
