my husband has registered for my spouse visa case. i have heared that it is the long time procedure taking upto 3 or 4 years. this situation is too much depressing for us. i m a computer engineer by profession. now i want to apply on student visa. my real interntions are for study so that when time comes and i join my husband, i dun want be a burden on him and want to become a useful citizen of america.i hv applied in a university in vergenia while my husband is in oklahoma. my question is can i apply on student visa while my spouse visa case is on process?

  1. You can always apply for your student visa while your other visa application is pending.

    - You can enter US on your student visa and then you can try to change the status as soon as you get your dependent visa


  2. im am pretty sure they will refuse ur student visa as they may see you as a risk to stay on if for some reason ur spouse visa is rejected

    it does not take 3 yrs to get a spouse visa they r given special attention

    write to the usa embassy and ask them how long the proceedurewill take as for ur  being a student do u realise that will cost thousands per yr so u will be better of waiting

    I know it is hard but usually it is 6-9 months goodluck

    and remember u r well within ur right to question the us embassy about processing times

    here are the 2 rules

    Immigrant visa for a Spouse of a U.S. Citizen (IR1 or CR1) - An immigrant Petition for Alien Relative, Form I-130 is required.

    Nonimmigrant visa for spouse (K-3) - It is important to note that application for the nonimmigrant visa for spouse (K-3) who married a U.S. citizen must be filed and the visa must be issued in the country where the marriage took place.  After the visa process has been completed, and the visa is issued, the spouse can travel to the United States to wait for the processing of the immigrant visa case. Two petitions are required:

    Petition for Alien Relative, Form 1-130; and

    Petition for Alien Fiancé (e), Form I-129F

    if you are going under  a K visa you should be given one failry quckly ie a temporary visa  so u can join ur husband in usa to await a permanent visa

    pls dont worry im sure ur husband realises u may not be able to work initially but that is what a marriae is all about

    so dont worry to much
