what is the term given to decisions of the Supreme Court that seem to make law, rather than interpret it ????????????? please help me ;)

  1. It is not correct thinking that the Supreme Court, "makes" laws.  What the Supreme Court does is strike down laws or uphold laws according to their interpretations of the Constitution.  This is right of the Supreme Court according to the Marbury v. Madison decision which was a case involving the Judiciary Act of 1801.  

    Most people who point to "judicial activism" as the Supreme Court making laws point to abortion being legal.  It is untrue to believe that the Supreme Court made abortion legal.  It not outlawed according to the Constitution, and the Supreme Court declared state laws making abortion illegal un-Constutitional according to a citizens right to privacy.
