Hit and run, am I in trouble?

I sold a truck on Ebay back in mid May. I informed the guy that I didn't have the title yet but I would be receiving it by next week. He said he couldn't wait that long to get the car, and that I could just ship him the title when it came in. I said that was fine and the guy picked up the car and drove the car home about 10 hours. The next week, I shipped him the title and he said he received it and all was well. I just got a phone call this morning from an insurance company saying that car was in a fatal hit and run accident back on June 10. They want info that I sold the car, because it had one of my plates on it (must have left one in the backseat when he bought it), and it was still registered to me. Am I liable for them putting my plates back on and hitting someone without registering it? I'm pretty sure I still have the bill of sale, but I also have the ebay auction listing that he won, but he paid me in cash when he picked it up..any ideas?

  1. If you dont have proper proof that he is the one who was driving the vehicle, or had purchased the vehicle you're on your own.  The situation with him using plates registered to you is a whole other story.  It can be argued on his side that he wasnt even driving it because why would he possess your plate.


  2. I think you should be fine.  

    Fax them all of the paperwork relating to the sale, including an emails between you and him.

    Give them all of his info and tell them to call him.

  3. As long as you have proof that you sold this car to him in May then you should be fine. However, in GA, it is your responsibility to let the tag office that you have sold a car so that it is not registered to you even if they keep your tag. But I still dont think you will be held responsible for the accident. Is the man not taking responsibility for the accident? If he is telling them that it is not his car then you need to be prepared to PROVE that you sold it to him. I hope everything works out for you.
