Hit by another car reversing down a one way street who's at fault?

Involved in a car accident where i was reversing out of a car spot and was hit by another car reversing down a one way street, who's at fault, been told by the insurance i am at fault even tho my duty of care was to look out for cars coming down the one way street.

  1. australian road rules state the reversing party must not do so unless safe.

    so, if you've been reversing AND the other person has been reversing too when you hit, then you are both at fault and usually each insurer will agree to pay for their own damages only.


  2. both cars reversing?

    in my jurisdiction both would be at fault - each responsible for his own damage.  I'm interested to see how it would differ down under.
