Question:

Holiday let down?

I had booked holiday flats months ago for this weekend. Last week the owner called to say there had been a mistake and they were double booked and would send me my deposit back (which he did). However the only other flats I could get have cost me a lot more now. Is he liable to pay the extra as I am out of pocket? Or do I not have a case? Thanks!

  1. I think he gave you back what you had paid ... so I don't think you have a case against him. But you can try and get a discount if you book with him again.

  2. There is no way you would see your extra money back from this landlord. We went once in Croatia and found out in front of the house that it was overbooked and we had to move to another apartment which was more expensive and nobody gave us those extra money we paid back.

  3. Im sorry to say you do not have a case because you excepted the deposit back off the owner what you should have done was tell him that as it was his mistake he can pay for whatever other flats you got....Sorry

  4. You lost your negotiating position when you accepted your deposit back.  You still may try to ask the owner to see if he can get a deal at one of the other flats in the area as he was the one who made the mistake.  However, he may not choose to do so as he has nothing to lose.  But, it never hurts to try.....

    good luck
