Home Owners Association and Potty Trained Kids?

I have a toddler (she is 19 months old and potty trained). The Home Owners Association in Smoke Tree from San Diego wont allow me to take my baby in the pool just because according to them it isn't possible to have a completely potty trained toddler. I get angry because what about the elderly people who wears depends? I just don't think is right. Even a 5 year old can urinate and p**p in the water. Does anyone knows about any law forbidding potty trained toddlers from using a pool? Any help? The regulation book from my HOA says completely potty trained kids and she is. Thank you!

  1. They won't let you bring her in even if she wore swim diapers??

I have seen pools that do not allow children under a certain age in the pool even with a swim diaper, mostly on cruise ships or resorts.  In that case they usually have a toddler only pool for them.  If they will allow her in with a swim diaper I would just use one and avoid the hassle.  They probably think you're lying about her being trained because 19 months is pretty young, most kids train later than that.  If it's in the written bylaws of your community then you might have a hard time changing it and you'll have to petition the board to have it amended.  I would try to win the support of other parents in your community, you're probably not the only one bothered by the rule.  

    BTW - I don't pee in the pool, and to anyone who intentionally does it (someone said they do): That's gross.  Don't be so lazy, just get out of the pool and go use the toilet.

For that matter, potty trained adults might let some pee slide now and again.  It sounds discriminatory to say the least.  Congrats on having a 19 month old potty trained child!  If it is a housing association, they have their own rules, and public pools have theirs.  You will have to abide by their rules, and it stinks, but I am not sure there is anything else you can do besides move to another location.

  4. lets face it potty treined or not we all pee in the pool, i will admit i do it....what makes them think that just cause we are adults we dont pee in there, am sure that more that one adult and potty trainned kids HAVE tinkle in there...you should get a group of mothers and complain about this!!!

  5. Your child is potty trained and you paid your home owners dues.And who are they to say your child is not potty trained. Next time you go to the pool and they tell you that, Tell them you will be contacting a lawyer because your child is potty trained and you paid your home owner dues. And do it.

  7. In my city the local pools have the right to forbid anyone from swimming, they did this because of a outbreak of that disease that comes from pooping in the pools
