i am looking at going to jail in new zealand for 3 years i think i have four children is there eny think i can do to prevent this they found me guilty of benefit fraud i am appaling i dident do this crim i was set up i need help so i can stay with my children i have a clean record otherwise and have to see the probation officer soon my lawyer says its for me to tell him about myself to help with what he thinks is best with senticing me eny ideas or can i apply before sentancing for home d man it makes me sick what is happing i dident do the crime so why shoul i pay for it help!!!!!!!!!!!

  1. Everyone is jail is innocent, no one in there did the crime.  You'll fit right in.

    And your children can stay with their father(s).


  2. You should be able to (or get your lawyer to) plead your case during court before the sentencing.

    Try to get any evidence to clear your name.  For example, see if you can get written statements from friends / family.  It may well pay to take somebody with you to court, as often, magistrates won't read statements as the person is not sworn in.

    Depending on your past record, I think your chances are pretty good for home detention, but only if you are a single father and the children REALLY have nowhere to go.
