Home insurance issue. my home was broken into between april 11th-27th. problem is my insurance policy lapsed?

on the april 17th. i didn't make it back to my property to discover the break in until the 27th. so how can a break in date even be determined. who's to say that it didn't occur before the lapse or after and all of my stuff was taken. i need to file a claim for my property. so how would that work?

  1. Yep, the way it works, if you don't know the exact date it happened, legally you use the date of discovery - which would be April 27th.  

    Sorry, no coverage.

Your policy is designed to pay by occurance date and this would be verified by the police report that you are suppose to turn in.  I don't know what you told them, or even if they were called, but the file date will definitely be after the expiration date (based on what you have said).  Don't even bother getting a lawyer as you have no proof of your claim.

  3. The date of loss they will use is the date on the police report, which would be the 27th...  Sorry, that means there would not be any coverage.

  4. Interesting question.  

    What is the effective date of the cancellation of your insurance?  Was it due to non-payment of premium?  Be aware that premiums are paid in advance, so the company might argue that coverage did not exist for the whole time the premium was not paid.  

    Also, since it's impossible to determine when the break in occurred, I'm sure the company will assume a date that is favorable to them.  

    It couldn't hurt to file a claim; the worst that could happen is they deny it.  

    You might want to speak to an attorney first, especially if the loss was large.
