  4. I am going through the Abeka homeschooling program for my children 6 and under. They have accredited and non accredited programs, although the accredited costs more. I am, however, going with the accredited and that way I do not have to keep up with all the work myself. They also keep up with all the grades for you as well. The website is listed below.

    A Legal Analysis

    2007-2008 Edition

    UTAH

Compulsory Attendance Ages: “a minor who is at least six years old, but younger than 18 years old” Utah Code Annotated § 53A-11-101(5)(a).

Required Days of Instruction: “same length of time as minors are required by law to receive instruction in public schools.” Utah Code Ann. § 53A-11-102(2)(b)(ii).

At least 990 instructional hours and 180 school days. Utah Admin. Code R277-419-3(A)(1) or for children in first grade, 810 hours. Utah Admin. Code R277-419-4(C)(4)

Required Subjects: “subjects the State Board of Education requires to be taught in public schools” Utah Code Ann. § 53A-11-102(2)(b)(i).

Elementary Schools (K-6): reading/language arts, math, science, social studies, the arts, health education, physical education, and educational technology. Utah Admin. Code R277-700-4

Middle Schools (7-8): language arts, math, science, social studies, the arts, physical education, health education, and career and technical education, life, and careers. Utah Admin. Code R277-700-5

High Schools (9-12): language arts, math, science, social studies, the arts, physical and health education, career and technical education, educational technology, general financial literacy, and library media skills. Utah Admin. Code R277-700-5.

Home School Statute: Utah Code Ann. § 53A-11-102(2).

A child “shall be excused from attendance” at the public school if the child’s parent annually files a signed affidavit with the minor’s school district.

    1. The parent must file an affidavit for each minor taught at home each year. The affidavit must contain a statement that the minor will be instructed in the subjects that the State Board of Education requires in public schools and that the minor will be instructed for the same length of time as minors are required by law to receive instruction in public schools. Utah Code Ann. 53A-11-102(2)(b).

    2. The parent of a minor who attends a valid homeschool is solely responsible for (i) the selection of instructional materials and textbooks, (ii) the time, place, and method of instruction, and (iii) the evaluation of the home school instruction. Utah Code Ann. 53A-11-102(2)(c).

    3. A local school board may not (i) require a parent of a minor who attends a home school to maintain educational records, (ii) require credentials for individuals providing home school instruction, (iii) inspect home school facilities, or (iv) require standardized or other testing of home school students. Utah Code Ann. 53A-11-102(2)(d).

    Utah UT-2

Alternative Statutes Allowing for Home Schools: Groups of home schoolers have established themselves as a “regularly established private school” under Utah Code Ann. § 53A-11-101.5. According to the Department of Education, it has no jurisdiction over private schools. The only requirement that may apply is obtaining a business license.

    Teacher Qualifications: None.

Standardized Tests: Not required by statute.

THIS ANALYSIS DOES NOT CONSTITUTE THE GIVING OF LEGAL ADVICE.

    =============

Basically you have to take attendance and keep records and teach the subjects listed in the law for the age/grade levels.

You have to file notice of intent for EACH child every year and state you will be teaching them the subjects as outlined by the law.

To teach groups of different children from different families MAY require a business license as a Private School.
