Housing and Council Tax Beniffits are sending around Baliffs if I do not pay £1000 were can I get a loan?

My Benifits were stopped for 1 week last year and I filled in an Automatic Reclaim Form thinking, as I was not informed otherwise, that I did not need to reapply for Housing/Council Tax Bennifits and now I am being stung for the £1000+. i AM IN RECIEPT OF ABOUT £60.50 p.w. I haven't any family that can loan me that sort of money and, as I've two dogs and some ver personal items that either relate to my late father or to my three children that are in foster care or have been adopted I do not want to lose them. I am pannicking and as do not want to become homeless.

I don't quite understand because the council should have been sending you council tax bills and, if you are a council tenant, rent statements, so you should have noticed that your housing and council tax benefit had been stopped from the amount they were asking you to pay. In any case, even if they didn't, you need to contact the council as soon as possible to arrange the repayment.  If you are on benefits they can only deduct a certain proportion of your money every week for it, probably something around £9.  Don't panic.  If you find the housing benefit department unhelpful you could go to one of your local councillor's surgeries, I did this recently as my housing benefit department kept making mistakes and misinforming me and she put me in touch straightaway with someone more senior in the department who sorted it out.

    you will pay them and not the council , the payment plan will be agreed by both parties and should work out

    the last thing they want to do is take goods that is a last resort and as much of a pain for them as it is for you

    Go to your local CAB on Monday morning

    Are you saying your Income Support stopped and as a result your Housing Benefit stopped as well? If so this is simply wrong. HB can be SUSPENDED if there is a question over your entitlement - IS will notify them you are not getting paid anymore, HB SUSPEND your claim and then must ask you questions to establish your entitlement, they can't simply end your claim just because IS has stopped. Go to CAB and get help with an 'anytime review' of your HB on the basis that you have had a continuous claim. They will say no, but appeal this. While under appeal they can not carry out any recovery action.

    HB have also got to show that you were correctly notified taht your claim was ended, which presumably the haven't as if they had you would have made a new claim. No proper notification then it is not recoverable.

    If you loose your appeal (which you wont if properly represented) ...The worst that can happen in such circumstances (because you are on IS) is that the council agree to Direct deductions from your IS of 3.70 per week toward the arrears. Bailiff action will be suspended during the period when you are appealing and can not be reinstated if you ask for these direct deductions.

    You need assistance with this see a welfare Rights Adviser free of charge at yor local CAB who can assist and fully advise on all the technicalities. Do not worry you are not going to loose your home or your possessions.

    Where—

    (a) payment of a claimant's housing benefit is suspended;

    (b) his benefit period comes to an end whilst the suspension is in force, and

    (c) no further claim for housing benefit has been received by the appropriate authority before the end of the benefit period,

    the appropriate authority shall invite the claimant to make a further claim for benefit and any claim made within 4 weeks of the end of the benefit period shall have effect immediately after the end of that benefit period.

  6. Sounds as if you have been ignoring the warning letters and now you will have to accept whatever happens.

    If you do owe this money then you will have to pay it back just like the rest of the tax payers.

    I believe they can not take things you need for living ie, cooker, fridge, bed etc but can take personal things like telly, video, dvd, radio, stereo, computer.

  8. You are not being "stung" you are being asked to do what the rest of us do, that is to pay your bills.

    Councils don't wait until people owe £1,000 and then senfdin the baillifs. They send constant reminder letters over a period of months.

    You have ignored all those letters, now it is time to pay your bills.

  9. what you need to do is first thing on Monday go to the CAB and ask them what you can do they will help you get a payment plan or even get it quashed as if you are on benefits you can not be held accountable for their  mistakes

  10. go to the council face to face and explain what has happened, they should be able to help set up a re paymant plan and stop the proceeding against you
