How Can I get Custody of My Sisters 6yr old son?

Pretty much my sister is not a terrible parent, but my mother and I feel she is very unfit and for his best intrest should live with me.

Please if you know how i can give me link to some information your inputs are very appreciated.

  1. If there is a legitimate reason for the child to be taken away from her, call child protective services and let them deal with it.  

    Here's a warning though:  If and when you sister gets her child back out of foster care, she may never speak to you again.

    You and your mother should butt-out and let that woman raise her child.


  2. wow... I can not believe you would actually want to take a child away from his mother!! Give her some tips on raising the child.. We all have to learn somehow... I can not believe you would resort streight to taking her child away from her!!

    talk to her about it..

    and if it is really that bad, maybe you schould explane it more in the question.. because from what you said, it just sounds like all you want is the kid and you are NOT considering the feelings of your sister.. She is your sister for goodness sake.. how would you like it if that happened to you??

    just give her some advise on how to raise her child better...

  3. If you feel she is unfit then first you need to contact Child Protective Services and they will deem whether she is is fit to be a parent or not.  Other than that there isn't anything you can do unless she wants to sign rights over on her own will.

  4. I dont believe in seperating a child from his mother unless there are REAL reasons to do so..

    Neglect, abuse, things like that.. unless she is doing something very very wrong you cannot legally take him.

    if you want to take him away because she might give him candy for breakfast, its really none of your business.

    Express your concerns to her.

  5. If you can prove that she is a bad parent with physical evidence, then you can present your case and you might be granted temporary emergency custody while your sister is investigated.

  6. It really depends on why you think she is unfit as his parent, and what would make you a better parent. I doubt you'd have a good argument at all, though. I mean, you said it yourself that she is not a terrible parent.

    Maybe you should try sitting with her and letting her know why you think she's not doing so well as a parent before trying to take her child away.
