How Do I Complain???

ok, i have a problem with Three, well my mum does, here is the long story cut short.

so my mum decided to get a new contract/phone out with three which is a Sony Ericsson. So she did, they said she will receive the phone on the 5/08/08. She never did. My mum rang Three up numerous times asking when it would be received and they said it will come soon. This has been said many times my mum phoned.

So today my mum phoned again today asking when the phone will come. Three said that the phone should have been delivered as my "mum" signed for the phone. No one in my family knows about this phone. Yet Three are saying that some man singed for my mum.

So we think the phone is stolen or the parcel dude might have given it to one of the neighbors but they haven't given it.

But on top of that Three want my mum to pay for the phone and the 12 month contract, what f**king twats.

They are also refusing to send a copy of the signature or info about this mysterious signing of the phone and are not

why were Three lying for 12 days

so what are my option??

how do i complain to???

should i take legal action and how???

thanks

  1. i would ask for supervisor . . it would have been great if you had prepaid legal before this happened it is awesome . i have it and wouldnt give it up for nothing . i sell it also . they would have got her another phone and quick with a letter. i would keep calling and complaining ask the company that delivered the phone supposidly to see the signature . and keep raising cain

  2. ring trading standards and get them on the case

the postie may have delivered it to the wrong address. they should be able (three that is) to tell you who signed and at what time it happened.

  3. It seems to me that the problem is theirs not yours. Write a letter to the customer services dept of the firm, outlining the situation. Keep it short and to the point as they will not be able to keep up. Tell them that as they have not fulfilled their side of the contract you are unable to continue with your side. Tell them politely where to stick their phone, if they ever find it, and visit a high street shop and get another deal. Keep a copy of your letter.

  4. My mates a postman and I've just asked your question. Recorded mail has to be signed for by a person at the address. That signature is held on record at the sorting office. All Three have is a guarantee the Royal Mail delivered the phone, (or maybe not).

Three are claiming the phone was delivered, you are saying it wasn't. You make no payments to Three as that is admitting liability, it's up to them to prove the phone was delivered, that's the whole point of it being a recorded delivery, the onus is not on you to do anything.

Middle ground here is the Royal Mail sorting office if Three wants to make a legal case they have to prove the phone was delivered. Somebody is obviously telling pork pies.
