How LONG can my Mom stay out of US after getting Green Card ?

My Mom got her Green Card on 11-15-2007 ( Nov. 15th, 2007 )

She was in the US at that time.

Time Stayed in USA --> 11-15-07 to 1-15-08 -- 2 Months

She went to INDIA & stayed there 1-15-08 to 5-15-08 -- 4 Months

She Came back to USA & stayed here 5-16-08 to 9-15-08 4 Months

Since Nov. 15th. 2007 .... She has stayed in USA for ( 2 4 ) 6 Months Total

Since Nov. 15th. 2007 .... She has stayed in INDIA for 4 Months Total

She is going to INDIA on 9-15-08 Again ....

HOW LONG CAN SHE STAY THERE IN INDIA CONTINOUSLY WITHOUT JEPORDIZING HER GREEN CARD ? She wants to stay there around 4-5 months. Is that OK ?

  1. go to the USCIS website, get the 1-800 number and call and ask

    I know my husband can leave the US and stay in the UK for 1 yr only, don't know about other countries


  2. I have heard in the past that its 6 months or less that you can stay out of the country

A LPR (Lawful Permant Resident) can leave the United States and remain outside the US for upto one year without loosing her LPR Status unless she has a valid Re-entry permit (REP).  That REP would allow her to remain outside the US and re-enter the US as long as that permit is valid, and REP's are generaly valid for two years from the date of issuance.

    Now if she is interested in applying to become a us citizen, then an absence of more than six months on any one trip can effect her continous residence.  Also she would have to be physically present in the US for 30 months out of the past five years to eligable.

  4. she can stay for up to 6 months as long as she maintains a home in the u.s., all the absences will not hurt her if she does not plan on applying for naturalization when she completes five years of LPR status
