How bad does harassment/ slander need to be in order to obtain a subpoena for the ISP?

Just how bad or excessive does harassment need to be before someone can hire an attorney and gain a subpoena from an internet service provider?

  1. it usually has to be really bad and they should have copies of the emails that was sent! good luck

First you sue.  Then you survive dismissal.  Then you schedule a deposition.  Then you send the subpoena and the service provider bring the records to the deposition.  A subpoena can only be used in aid of an existing lawsuit, not to held decide if you have a lawsuit.  So, it has to be bad enough to state a claim in court, sufficient to avoid dismissal.
