i was in a commerical building on the first fl..when ceiling fell on head ...ems came....i suffer head aches neck and back pain...out of work 3 mths! i hired a lawyer...plus i take therapy until sept! iam still hurt how much money will i get? management company agreed to accident ,,,,it was caused by a plumbing pipe,,burst .''

  1. No idea.  This should be a workers comp claim, so your comp carrier is entitled to reimbursement for anything they've already paid out.  

    If there wasn't any negligence involved, and you have no permanent injuries,  it's not going to be much more than medical bills and lost wages.

    You've hired a lawyer.  They should be able to answer this question.


  2. You lawyer needs to go to work in your behalf to secure a settlement for you.  In many states the amount would be limited to lost income plus actual damages (your costs).  Pain and suffering might be nil.  In other places it is limited.  If your lawyer doesn't know, you have the wrong lawyer.

  3. You have hired an attorney.

    You will be paying your attorney a huge portion of any settlement you get. Easily 33% plus expenses.

    Therefore, ask him.

  4. Based upon your question, I don't know clearly whether or not you were working/ a worker of this company, or just someone in the building. If you were a random dude walking in this building, different rules apply than whether or not you were working for them or hurt on the job. Either way, the best person to answer this question is your attorney, because no one will be able to predict the amount of settlement you get.

    With the attorney's fees, you will also need to gauge the risk of drawing out the suit into a long, arduous process, or accepting a settlement so that you can be done with it.
