Question:

How can I be charged with the same crime twice?

It is the exact same charge and I only did it once. Will one of them be thrown out? Or is this the legal systems way of making sure the book is thrown at me so to speak?

  1. well.... like some one said you can be charged differnt things in the same crime but not the same exact thin. and if you have already went throw this they CANT not charge you with the same crime even if their is new ecidence. once it is closed it is Closed


  2. Charged, arrested. or convicted???? You can't be punished for the same crime twice, that would be double jeopardy. You state that you only did it once, did the D.A. file charges on you then?  Or was it blue sheeted ?(District Attorney didn't file but has a year and a day to do so) Don't you have a Public Defender, state appointed, or your own attorney representing you?

  3. if you are found either not guilty or guilty the other charges will not be considered but the charger is trying to make sure that you get convicted by breaking a law right out of The Constitution.

    also twice put in Jeapordy of life is not the whole thing it says or LIMB which means a lesser charge.

    but once you are convicted or not guilty they can not try you for it again

  6. You can be charged for a crime as many times as someone wants to charge you with it. You can only be convicted of the same crime for the same incident once.

  7. If you only did this act specifically on 1 occassion, they can only convict you once.  But as many people stated they can charge you with many different things.

    EXP.  You Forge Someones Check and Go Cash it at a Bank.

    While that is part of the same crime, there are several different crimes you committed:

    Going into the business, office, residence, etc where you got the check (not necessarily breaking in - you could have gone to work that day and while at work took it out of the accounting office) - BURGLARY

    Signing the check - Uttering a Forged Security

    Cashing the Check and getting the money - Theft or  Obtaining Money Under False Pretenses

    Because it is a bank and is FDIC insured:  Bank Fraud - A Federal Crime

    So, you can be charged and convicted of all of those even though it was just 1 check.

    If you are saying that you were charged with the same offense, using the same statute twice and only did it once, one will have to be dropped - your attorney or PD needs to motion for that charge to be dropped at your preliminary or arraignment hearing.
