Question:

How can I be sure that my grandmother's will is carried out like she wanted?

My father claims he found a will in a box in her home that was dated over 30 years ago in which he was named sole heir to her estate. He is an only child. My grandmother told not only me but my sister & my mother that when my father & mother divorced (20 years ago) that she had the will changed that her estate was to be divided three ways, between my dad, my sister & me. My father is claiming that he has found only the old will & everything belongs to him.

How can we find out if there was indeed another will? If we are named don't we have to be there when it's read?

Also, what if it wasn't prepared by an attorney?

  1. If you are named then yes you have to be there when it is read. The only way to find out is to ask her. If she has since passed see if she had had a lawyer ask around. Family members and or call lawyers offices.

    Prayer works ask God to guide you and he will.

  2. Depends on what state. If the will was notorized then it can be the same as an attorney. Either way you would need to file for contest of the will, it sounds like.

    I hate it when families tear eachother up.

  3. It seems like the burden of proof is on you.

  4. You will have to find the will.  Try talking to her lawyer.  Even if there is a will and you are named, you do not need to be at the reading.  If it was not prepared by a lawyer, it would have had to be signed and witnessed or else it is not valid.

  5. hire an investigator and an attorney. you can always challenge it in court if it's that old.  

  6. Check with your local Probate Court. This is where wills are filed (if at all). Otherwise, you will need to find any new will. I am amazed that people think things will be done as wished but cannot take the time to guarantee it.
