Question:

How can I break a commercial lease?

I moved my retail business into a large complex that was being billed as a retail center in the center of town. Rather than seeking out other retail shops and restaurants, as was promised, the landlord's only other tenants are law firms, and no retail shops.

Now I'm struggling to get any business because I moved into what was advertised as a retail shopping center and find myself the only retail business.

Can I break my lease because my landlord failed to get any other retail shops?

  1. Unless it was part of your lease agreement that he was going to put other retail shops in your complex, probably not.  You can talk to your landlord and see if there is anything that can be done, but I'm guessing that you will be stuck.  Any court is going to go by the rental agreement, and if you signed it, you have to abide by what it says.

    Good luck!
