How can I change my daughters last name?

When my child was born the guy that I thought was the father gave her his last name, after a paternity test it came out that he wasn't the father. How can I change her last name, does he have any rights?

  1. Someone who has been proven not to be biologically related to a child has no rights to that child.

    Go see your town clerk for information on how to change your child's name.


  2. It's very expensive to get a name change; you need a lawyer to explain the process.  But, yes, the guy whose name is on the birth certificate is the legal father now. He has rights and he has obligations (support) unless he is willing to go to court and repeal his rights.  It's going to be expensive legally for you. Too bad you didn't know who her real dad was.

  3. If he isn't her biological father - then he has no rights unless you want him to. If you want to change her last name, you can go to your county's courthouse & they usually have forms there... it's called a "request for minor name change" form. The fees vary - I live in Washington State & it costs about $100, but I know if you're low income, you can often do this for free (the courthouse will wave the fees with proof that you're low income). Usually, both parents have to agree to the name change & give good reason for it. But if he isn't her biological father, only you need to agree to the change. And your good reason is that he isn't her real dad. Good luck to you!
