I am a patient and I want to file a lawsuit because I feel I was not treated the way I wanted to be and he refused to prescribe something I needed for a cosmetic related illness. How would I go about filing a lawsuit? Please explain the process. It is important. Is it costly? Please explain details.

  1. If its cosmetic related the doctor is not required to prescribe you medication unless you are suffering mentally from this (i.e. depression from really bad acne) - the legal process is long, expensive an complicated with no guarantee you will win. Your best bet is really to try to avoid the legal route, it is not the quick and easy method some people believe it to be, maybe try getting a different doctor or explaining to your current one why you feel you need the medication. The cosmetic nature of this illness could really count against you in court.

  2. No case.

  3. He is not obliged to prescribe any drug that he thinks is not suitable for your condition.

The chances of you winning this sort of case would be slim to none.  It would be very expensive.

Better to go and get a second opinion.
