How can I find out if a company has workman comp insurance?

My husband has hurt his back at work (construction) and he went for an MRI today, the company told him that the injury wouldn't be covered. That is hard for me to believe. Can anyone help us please? Thanks

  1. Well, an employer is required by law to post the workers comp claim information.

    When you say  construction, that tells me the company doesn't HAVE any workers comp coverage.

    From your point of view - ask them for a copy of the denial letter from the insurance company.  

    Bottom line - if they have no coverage, you're going to have to sue them for it - and if you get a judgement, you THEN have to try to collect.  And with construction industry, it's much easier to file bankruptcy and start all over again with a new corporate name.  

    But you can file a complaint with your state department of labor, also - who could just flat out shut them down.  

    Meanwhile YOU are stuck with the medical bills, unless you have health insurance.

  2. Well depending which state you are at no matter companies are required to have work comp insurance.

    If your husband was a independent contractor and was hired by this construction company there could be a problem unless there was control from that construction company.

    However I would call the workers comp division in your state, they should have all the records.  Check the website of the state you work in, like Utah Workers Compensation board or something along the lines of that and normally there is a spot of who covers the company.

  3. Was he working as a bona fide employee or as an independent contractor?  If he's an actual employee, his employer is required to carry WC coverage.  If he's an independent contractor, that law doesn't apply.

  4. well i know in washington state all comapnies are by law to have workmans comp, unless your an indipendant contractor. Call your state attorney generals office, the state DSHS, and ask them about it. also if you have a lawyer talk to them about a possible lawsuit.

  5. If he is an employee, he should speak to someone in Human Resources/Personnel and say he wants to file a workers compensation claim.  They can't deny him from filing a claim.

    If he is an independent contractor rather than an employee, then it is possible he was told the right answer.
