  1. if she lives with you and you never signed over rights to allow him to claim her (specific tax form for that- form # escapes me at the moment) - just file you return with her on it and see what happens - since you are custodial parent - you have the first right to claim her and they will make your ex pay back refunds and charge him penalty and interest on taxes he tried to avoid - If he tried claiming her and the IRS contacts you , tell them you never gave him permission to claim her and without him having that signed tax form from you, they should believe you and punish him - I tried that once - yrs ago with my ex - got the refund initially, then they came back after me for the $2000 plus interest and penalty - took me 18 months to pay the IRS back- gave up on trying to claim the kids after that


  2. You can't.  Tax returns are confidential between the taxpayer and the IRS.

    If you're expecting an offset from his tax refund for unpaid child support there are a number of reasons that you don't receive it that have nothing to do with his filing or not filing a tax return.  

    If he's not due a refund, there's nothing to offset.  Many deadbeats quickly figure out that if they adjust their withholdings to result in a small debt at tax time, there can't be an offset and that's perfectly LEGAL.  

    Or he could have debts that rank higher than child support when it comes to offsets.  Unpaid student loans in default come ahead of child support debts as do back taxes and other government debts.  

    Then there's the deadbeat that would rather let his refund go to the government than his kids.  They would receive a refund if they filed, but if you are due a refund and don't file the IRS will happily keep the money and won't force the issue on the un-filed tax returns.

You can't.  If he owes back child support and the proper paperwork has been filed to intercept his refund if he has one, then you'd know when you got the money.  And your local child support authority might be able to tell you if there is something coming.  But if you don't get anything, you won't know if he didn't file or just didn't have a refund coming.
