How can I get a US green card for my mother in India (She was a former green card holder)?

My parents returned to India when my father retired. Both were US green card holders for decades. My father has passed away and I want to bring my mother back to the US to care for her as soon as possible. How do I reinstate her green card?

  1. If you are an American citizen over the age of 21, you could file an I-130 immigrant visa petition for her and qualify her for a new green card. If you aren't and you don't have any American citizen siblings over the age of 21, then I doubt you'll be able to help her. Check out uscis.gov on what forms are needed and how to file, if you can.


  2. You can't, it's illegal. You go back to India and take care of her there like a good son should.
