How can I get a title for my car for this situation????

I live in Oregon. In March 2007 my girlfriend, who lived with me, moved to Colorado. Before she left, she sold me her Camry for $1000. I wrote her a check for $1000 which she cashed within a month. I still have the carbon copy plus a Bill of Sale slip from the Oregon DMV filled out in pen w/ both her and my signatures. The problem is, is she didn't have the title to the car which is in her name. Like silly couples do, we never did anything about it and life goes on. Me, being the idiot that I am, drive this car around until the present day w/ no current registration as of this year and no insurance. Of course the day comes about 3-4 weeks back I get pulled over and ticketed for both instances. I email the girl (now an ex) and she says yeah yeah, she'll help, but of course never follows through and now doesn't respond to email. Two days ago I get another ticket so now I'm fed up. The car's title supposedly originated from California. The car has Colorado plates. I live in Oregon. Apparently one must have the title before they can get the registration part done in Oregon. Sorry for the wall of text, but have fun w/ this one, and thanks for your answers in advance. As of now I plan to go into the DMV on Monday to see if there are any alternatives, but yeah, if you know something, say it :) :)

  1. If the DMV can't help you, the only other option is to take her to court. File a lawsuit in your state. If she doesn't show up for court, she'll be charged with contempt. I would bet if you have a lawyer call her, you would have the title in your hands within a few days. It's sad, but, sometimes you just have to be a pr**k about things.

All I can tell you is the seller is obligated to provide the buyer with a merchantable title at the time of sale.  The buyer would be wise to make sure they have that merchantable title in their hands before forking over one red cent. What happens now?   You can explain to your ex that it would be prudent for her to get that title to you ASAP because it is still legally her car and she is responsible for that car.  In an accident, they are going to come looking for her !  In short, scare her into providing you with that title !  Good luck

  3. You've got the right idea, head for DMV.

    You'll find yourself on one those roads not unlike trying to clear up your credit report. It's a troublesome road with bumps and dips.......But you will find the end, and with a little luck, more sooner than later.

You need to speak with the Police about filing "theft by deception" charge against her.  Since she took the money and signed the car over to you, you paid her for something and have proof.  If she can get you a title, it will happen fast with a little heat on her.  Besides she is an ex, and it will stick in her craw.
