How can I get more money from a car accident insurance claim?

I got in an accident and wasnt at fault, the lady who hit me didnt have insurance... and my medical bills are about 3800! but I kind of need a bit more than that! i bought a car, had to pay gas when i was without one.. what do you think?

    Or take her to small claims courts without an attorney - you can claim up to $5,000 in small claims.

  3. Check your insurance coverage. If you have UM or uninsured motorist coverage then that coverage acts like its the lady who hits you insurance and you can make a claim against it for your medical bills and any pain and suffering up to the limit you have. You can also make the claim for your car damages to it.  Although I'm wondering if you already had that covered by collision coverage? Also check for medical payments coverage or PIP coverage that should also pay your medical bills up to the limit.  If you don't have coverage or don't have UM or medical payment or PIP coverage then you are likely out of luck.  However if she is at fault and you have that much in medical bills I would think about taking her small claims court of possibly getting an attorney.  Although she may have no money so you may be out of luck on being able to get anything from her directly.
