Question:

How can I get my bofriend out of my home that I added him to my lease?

My bofriend and i are renting a home.He assaulted me the other day cops say I couldn't come back to my home even though I added him to lease.I've contacted my landlord she is working on a new lease without him on it.I can then have him removed right?I can't even get in to get some clothes he changed the locks and my landlord didn't know that either.Can he do that?

  1. Geesh, your landlord is an idiot.

    She can not simply just write up a new lease and leave him off.

    This is your boyfriends home, legally you have equal rights to it.

    The police will help you get your stuff, but they will not remove him, neither can the landlord.

    She can try to evict him through the courts, but fighting with you is not legal grounds if her state requires grounds for eviction.


  2. Im pretty sure he doesnt have the permission to change the locks on the doors because the landord has a right to access the apartment, landlord is probably on working on a way to evict him, and that might help.

    If you haven't already, get a restraining order, but until that lease is trashed and a new one is instated, he has every right to be there as you do. And if he's that dangerous, I wouldn't go near it.

    Also, another option is to have the court assign you a police officer to escort you into the building so you can get your things.

    Anyway, you and/or your LL can evict him.

    A lease is a legally binding contract, and the landlord is just as bound as he is.

    Something is VERY, VERY FISHY with your story.

    I have NEVER heard of cops telling the VICTIM that they cannot return to the home...so it sounds like you assulted him rather than the other way around.  Usually they tell the criminal to leave and you didn't mention him getting arrested...and if he really assaulted you, he would have been.

    He can't change the locks and your landlord has a legal right to change them back.

    If you want the place, then you'll have to sue him in court to have him removed.

    What your landlord is doing is against the law b/c guess what?  She doesn't have legal grounds to evict him (b/c he hasn't been arrested for anything) and she can't, on her own, say you have more rights to be there than you do because you are BOTH on the lease.

    If she tells him to leave, guess what?  

    HE DOESN'T HAVE TO!

    PS:  I also find it strange that you obviously went back to the apartment after he ALLEGEDLY assaulted you
