Question:

How can I get out of my 12 month lease in an apartment? I have a bad back and I live upstairs?

I've been living upstairs for 4 months and im on a twelve month lease. I've asked the property manager if there is a simple fee to get out of the lease but she says that ill be responsible for the 1400 dollar rent till the lease is over. I've been to the doctor recently and I have been diagnosed with a stress fracture in my spine and i have trouble walking up and down the stairs. Is there a way out of the lease? And i wouldn't want them to move us to a downstairs unit either cause frankly I dont like the complex : )

  1. I think you should just compramise and suck it up and move downstairs -- they get their money and you get your situation resolved.

    Sounds like you want to use your back as an excuse to get out of a contract that you signed, which is not cool at all.

    If they move you downstairs, your back issue is resolved -- anything beyond that is just using it as a cover.

You have a LEGAL OBLIGATION to pay the agreed rental sum, you do not have to remain in the property however, they cannot force you to stay there, only to pay the rent and make sure the apartment is in good order. DO NOT listen to the advice of the first answer, DO NOT sublet. you will be evicted, (which you may see as a good thing) but you will also have to pay fees for the eviction and you will have a court order against your name.

    Get your Doctor to send a medical note to your landlord, and look for something else. If they offer you to swap toa ground floor flat, take up the compromise, but say you will not sign another lease, and will continue your current one in the new property. PErhaps speak to your neighbours, see if they'd be willing to do a swap. Get them on your side.

  3. You are advised to take a first floor apartment in the same complex.  It's apparent from your question that you are looking for an excuse to move out entirely because you don't like the place.  Your 'bad back' isn't going to cut it, especially if they offer to move you to a lower unit.

    You should have inspected the complex more carefully before you signed the lease.

  4. Seriously now... Your in to the first 4 months at the APT. I would suck it up and at the same time start looking for a new APT if you are in seriouse medical issue. I am sorry you are in pain, but the manager has the rights to refuse service to you if you already sign the agreements. Even a lawer will not help you out they would think it is a waste of time.

    My suggestion is...have your appartment rented out to some  college kidd who needs a room for the year or 7 months, so that you can have him pay it off with you not being there, while you move in to your family or a friends house for the mean time till the least is up. At the same time, find a new APT with a lower level the kick the kidd and end the lease.

    Sound evil...but it should work.
