How can I give parental rights to my partner, who is not my daughter's birth father but would like to adopt?

  1. You have to get the childs father to give up his parental rights.


  2. Marry your  partner and then file papers so he can adopt her.  Of course the child's birth father will have to agree  to have this done. You can't just "assign" parental rights to another person without his consent unless he's in prison or there are other extenuating circumstances.  Is he involved in his daughter's life in any way? Is he paying child support? If no to those questions, you may be able to file for sole legal and physical custody and if he doesn't show up in court it would make it easier for you to get an adoption approved by the court.  I don't know what state you live in though, so it may be different where you live (I'm in CA)  

  3. Your daughters birth father needs to forfeit his parental rights and your boyfriend has to file adoption papers with the court.
