He decided to move to other state for college. Our lease will end in 9 months. I cannot break the lease. I want to stay here. I dont allow his name to remove off the lease. How can I make him to pay half rent on this lease? A Notary?

  1. The only way to force him to pay is to sue him, win a judgment and then enforce the judgment by attaching his bank account or garnishing his wages.

A notary has nothing to do with it.

  2. you are both responsible for 100% of the rent payment.  What you arrange between yourself and him is between you and him, your landlord doesn't care.

I would recommend getting him to sublease his portion out.

  3. Just tell him that his name is on the lease and it doesn't end for nine months so he has to pay his share of the rent.  Tell him that if he doesn't pay half the rent that you will be contacting an attorney.  Maybe you could get a roommate to pay for half the rent.

  4. He legally has to pay the rent but that doesn't help you because he is not paying the rent.  You may have to advertise for a roommate to pay his share.  A notary can not help you. An attorney could write him a scary letter but it would probably not get him to pay if he's in another state.

  5. Wow, thats a tough one, if he doesnt live there than really he shouldnt have to pay, buut if he agreed to stick in there through the lease then yes he needs to pay his half until the lease is up its only fair.

  6. No, this is not a job for a notary.  You will have to take him to court and that isn't going to be easy since he is out of state.

You may as well look for a new roommate to share the costs.
