How can I push supervised visitation?

My boyfriends ex wife is bad news. She neglects our child when he goes over there. So far, she has let him fall down the stairs,causing scratches all over his face, he's had pin worms, a double ear infection, and she let his fever get so high one time that he had a siezure. It is court ordered that she gets visitation, but how can we get supervised so that we know our baby is being watched?

  1. You don't need an attorney in this case.  You need to petition for supervised visitation and simply attach a copy of the pictures from his fall, doctor reports and a medication list.  You need to prove your case along with your petition, but it's easy to do if you've saved a paper trail of all the neglect that has led to crisis situtations for your son.

  3. I would get an attorney right away!

    I had issues with my ex too. He did stupid, neglectful stuff all the time. I knew he would never change and I decided that my daughter would not go over there any more and I was willing to go to jail to protect her. Luckily he knew he wouldn't stand a chance in court and hasn't challenged me.

    He had to "one up" me and not contact her at all which hurt her feelings - but at least she is still alive and deeply loved by lots of other family members.

  4. you will need to hire an attorney and present as much proof as possible.  An attorney would be able to tell you if you had a strong case or not.  Go for a consultation.

  6. You may be able to represent yourself, but you do need to go through the court. Document every incident. Every time your child comes home, keep a log of the child's complaints and marks and bruises. Good luck. (Since your boyfriend seems to have primary custody, he should check out fatherhood.org. They may help provide an attorney for him.)

  7. You will definitly need proof of this happening, without it, the courts won't even look at it. I can tell you for a fact that she did NOT cause the ear infection, that is just something that happened. Other suggestion would be (depending on the childs age) is to make sure he has a friend or one your family members present while she is with him. If she really is neglectful, you might call CPS on her and have them investigate the home and take it from there, but you will need the help of an attorney to change the court order.
