How can I register a trademark online?

I represent a foreign NGO, can I regiter and pay it online?. NGO's trademarks are cheaper? Thankyou

  1. For U.S. Trademarks:

    (1) Go to USPTO.gov, click on "Trademarks" on the lefthand side; that will give you all the information you need.

    (Yes, you can register and pay online; no, NGO's trademarks are not cheaper, but trademark apps themselves aren't all that expensive)

    (2) Registration in the U.S. means that you've actually used the mark in interstate commerce in the United States (on the goods or services provided, not just on advertising) OR that you have a bona fide intent to do so.  The mark must be distinctive (i.e. not a generic or descriptive word, after any foreign word translation, unless you can establish "secondary meaning" in the mark).  

    (3) If you have a registration in a foreign country, there certain conventions that allow you to seek registration in the United States.  That's more complicated, and you should seek local trademark counsel about it.

    (4) It's always a good idea to have a trademark attorney file this application for you.  It will cost a few hundred dollars more, but it will save lots of headaches, as they are good at the "form" the trademark office likes (including the description of goods and services, which can often be a sticking point).
