How can I safely file bankruptcy, in Washington State, if I don't have the money for a lawyer?

Me and my wife need to file but don't have the money for a lawyer, is there anything we can do?

  1. A lot of bankruptcy agencies offer payment installments. Nothing is for free.

  5. Unfortunately, the federal bankruptcy laws have been revised recently (2005) and dependent on which kind of bankruptcy you are trying to file (chapter 13 or chapter 7) you may need a lawyer. It is a real headache without one if you are planning on filing a chapter 7, but by law you don't need a lawyer and are entitled to all the information that a lawyer has access to. In short if you file a chapter 7 I would recommend that you get a lawyer if at all possible, if not be prepared to spend a lot of time doing your research here is a site that might help: http://www.law.cornell.edu/rules/frbp/ you can also look up chapter 7 on Wikipedia  just to get a general idea of what it will be like to file on your own.

  7. Yes,youcan do it yourself through "we the people". It is cheaper then a lawyer. However, if you have a house,cars,credits cards,property etc...then you need a lawyer.

Generally when you meet with an attorney (there's no cost for the first consultation meeting) and it is determined that you are a candidate for bankruptcy then the attorney will probably advise you to stop making all debt payments at that time. If you aren't making any payments on the accounts that will be discharged then it would be relatively easy to come up with the cash to pay the attorney. The attorney will have suggestions - they want to get paid too.

  9. Sandy J........ daddylonglegs2003's post is absolutely correct. You can schedule an appointment with a local bankruptcy attorney and get in to see them on a free consult. They will want to see your last 6 months of paystubs, assets, list of debts and the last 4 years of taxes, once reviewed they will be able to tell you what you qualify for. They will be able to tell you from looking over your debts what you can and cannot pay in order to come up with the retainer fee they charge. The bankruptcy will run you anywhere from 800.00 to 1500.00, and could be more, depending on what you are filing and what type of assets you have. It really depends on how much work the case will be to handle. Some attorney's will do payments until you pay in full and can file your bk. Per some of the posts. I would suggest you contact attorney rather than try to accomplish a bankruptcy on your own. The new laws are strict and one wrong move and the case is dismissed.
