How can I sell this house? (not a typical case)

I bought this house from someone who gave me a great deal on it because it needs a LOT of work on it. However, just after I bought it, I had a bad accident that means I can't work anymore, therefore have the extra money to fix the house. Now I just want to get rid of it - because since I own it, I can't get the SSI I need to survive since SS terms it as a potential form of income.

I have someone who really wants it - but when the guy signed the house over to me, for some reason the title of trustee was added to my name as owner. I am the only one on the deed, but I am told that I can't sell it as trustee??? How do I get this fixed?

  1. Trustee for who, the seller?? It sounds like you just bought the thing regularly and it got recorded wrong.  First off I'd go down to the courthouse and talk to them there.  Bring your contract and closing statement and just tell them the thing was recorded wrong and can they fix it.  They may just take all the info from you and put in to have the thing changed (though it may take awhile for the change to get made).  

    If they won't handle it (or you just don't want to go to that much trouble) then call up the closing agent and explain it all to them, they'll be able to get the title changed to what it should be.


  2. You are ok.  You own the house.  You have options:

    Go back to the escrow company you used and have them do a Correction Deed.  They won't charge you.

    Sell the house today but first walk into any title company and tell them that you are not a Trustee. Do they want you to write a piece of paper saying that you have designated yourself as Trustee. If yes, get a white piece of paper and say that you elect yourself as Trustee for your affairs

    Just go to a bookstore and get a deed.  Sign it to the buyer and have him pay you cash.  He might pay you less because you didn't use a title company but no law says you must use them. /

  3. Maybe it is time to hire the attorney you should have hired before you bought the property, to try to unravel this.  What kind of trust is it, whose trust is it, and who is the beneficiary?

  4. Did you use a lawyer when you bought the house?  If so, call the lawyer and ask about why it says title of trustee and what you need to do to sell it.

  5. Ok...I'm confused.

    Did you buy the house or not?  Did you use an attorney?

    You are not an attorney so you can NEVER be a trustee.  You need to see a real estate attorney about fixing the situation.  

    You paid for the house, so your name should be the ONLY one as the owner such as "John Doe, a single man".

    An attorney shouldn't charge more than $75 to fix it, and may do it for filing costs only if you tell him you recently had an accident.
