Question:

How can Indian Casinos in Michigan fire people because they are white?

At an unnamed Indian Casino here in Michigan, they are cutting costs and cleaning house. Amazingly all of the firings have been the white people who work there. There is one left and he is biding his time..... How can they get away with this? I have two thoughts, but don;t know if either is right. 1)they are a privately owned business and since they are not public, some of the hiring rules don't apply to them. 2)they hold sovereign nation status and none of the rules apply to them.

I don't know for sure any ideas???

  1. This can be taken to court this is discrimination due to race. The only thing. Can you prove the white people are being discriminated against? Do you have proof? Do you have substantial evidence claiming the casino has treated you different than the native people. It's easy to sue not easy to win. You also have to read the agreements like the gentlemen above me have stated.

  3. Mosy likely the second one depending on the treaty they signed with the US government.

    And, if they are truly sovereign, odds are the employees would only be able to take their complaints up in Indian courts.  Unless, like in MN, the state and tribe have an agreement on how the casino operates.

    Only a few states have agreements with Indian Tribes that basically make them co-equals of sorts and allows the states to do the majority of co-governing that the feds do.

    I think Minnesota, California, Montana and a few other states have these powers from the treaties signed with Uncle Sam.  I dont recall Michigan being one.

    So odds are, the tribe can hire/fire whomever they please, esp if not part of the tribe.
