How can a person not give your own money if they are your payee?

how can Lutheran social services keep money from me and not allow me to pay my house bills and then deny me the access to let me try and have my husband become my payee and no one at social security will let my husband be my payee because he has no job and they won't allow him to be my payee how is that possible?

  1. If a church is helping you pay your bills, it should only be temporary.  If SSI won't allow your husband to be the payee because he doesn't have a job, he needs to get a job, or apply for SSI himself.

    why doesn't he have a job??? if he had one then this wouldn't happen....

If they are your payee, they should be paying your bills for you and giving you the money that's left over after putting some away for savings.  Your husband not having a job wouldn't be the only consideration for whether or not he can be your payee.  If they aren't handling your money right, you need to report them and apply for a new payee.  You can request that your husband be considered, but he would have to go through a qualifying process, it's not automatic just because you want him to be or because he's your husband.  Social security doesn't decide who your payee is, the court does, you need to go through probate court and ask for a new payee or a guardian ad litem (or however you spell that).

  4. Not understanding.  If you are getting assistance through your local social services office they are going to take your social security benefits as repayment, I would assume.  I know where I live that is how it works in certain situations.

If social security pays the money directly to the Lutheran social services, they are supposed to provide you with some/all of that money on a schedule (not necessarily all at once).  Talk to someone at LSS and find out when/how they will give that money to you.  If they won't, ask what you get in exchange (do you get food or reduced housing, etc).
