How can a realtor adveritse a property when they do not represent the seller?

I have been tracking a property for 2 months and it is now an reo property. The realtor that is advertising the property represented the seller prior to the trustee sale. After the property was forclosed on, the realtor has advertised the property for sale on a daily basis. I have contacted the bank that owns the property and they have not gone through all of the legal paperwork to resell the proprtey yet. So how can this realtor advertise on the internet if they do not represent the seller?

  1. The agent is not doing anything wrong. They had the right to put an ad in the paper before it went to the bank. It'll be hard to prove that the agent didn't have that ad placed to run before the foreclosure. Not only that, but the bank probably appreciates that this agent is advertising their house, which will help them get it off their hands faster.

    Even if the agent never had a listing on a house, they can get written authorization to let them advertise the property and then they could place as many ads on it as they please. He/she may have simply gotten permission from the bank to continue to advertise the property. The lender may even have let him/her be their agent.


  2. When he put the ad on the internet he may have bought ad space for a set amount of time which has not expired yet. Or it may have expired and the website just hasn't taken it down. If yuor really interested in the property contact the bank that bought it back. I bet they are more than willing to get rid of it.
