Question:

How can a u.s citizen file a petition for a spouse that is living the u.s already?

3months ago i became us citizen and now i want to file a petition for my husband to become a u.s resident , what do i need ,how much $$ that's it take,which is the form to file,do i need a lawyer,how long that;s it take,i already when to the government page to find out what to do but i haven't got a answer!!!

    #1 file form I-130 petition for adjustment of status.

    #2 if your husband has had any contact with immigration or the law a lawyer would have to present your case or your chances of getting the petition approved would be slim.

    #3 maybe $2,000 or more.plus you have to make 125% above poverty level to qualify or you need to use a co-sponsor.

    #4 it can take between 16 months to 3 years.

  3. If he is here illegally, there is nothing you can do for him now.  He would need to go back to his own country and you then would petition for him to come back legally.

  4. First question, what's his status?  Is he here legally or illegally?  If he's illegal, did he come with a visa and overstay?

    If he's illegal and came illegally you're in for a huge, expensive, process with no guarantee of success.  It must start with him going back to his own country and you filing Forms I-130, I-864 and G-325A with the USCIS.  The fee is $355.  You can find the forms here.....

    After his interview he'll be rejected.  At that point he'll file a request for a Waiver of Inadmissibility using Form I-601.

    If he came to the USA with a visa and it's expired, or still good, you file Forms I-130, I-864 and G-325A.  He will file I-485, I-765, I-131 and G-325A.  You'll file all these forms at the same time, in the same envelope.  The cost to file will be $1,365.

    He can stay while everything is being processed.  He'll get a work permit in about 90 days.  He'll have his interview in about 6 months and get his green card in about a year.

  5. is he here legally?...if he is here on a visa, other than the j1 then you can file the I-130 and he can stay here through the process.  if he is here illegally or overstayed a visa, same thing, he will have to return to his country of citizenship while you file it.  really depends on the situation.  If he is here illegally, they will make it real hard on you, long long process.
