How can an unelected Supreme Court impact the legislation?

  1. The job of the Supreme Court is to interpret the laws passed by Congress and to make sure that the Executive Branch, the president, carries out the laws within the Constitution. The idea that no 1 Branch may be stronger than the other 2 branches is called Checks and Balances. The Court may declare any law passsed by Congress or any presidential act

    unconstitutional, called Judicial Review. The idea is that the court, being unelected, is not influenced by politics or election year tactics but instead they are influenced by the merrits of a case. Sometimes this works and sometimes it does not work out as well as hoped for BUT IT IS STILL A GOOD SYSTEM CONSIDERING IT ISS OVER 210 YEARS OLD.

  2. unfortunately the supreme court has interpreted one phrase (i.e. "implied powers") as meaning that they have ultimate power to determine the legality of legislation and thereby negate or support any piece of legislation passed. it is a very unfortunate thing.

  3. By interpreting the legislation any way they feel like, with no sense of legal discipline at all, with pure sophistry.

Their Only Job is to Interpret the law as written!  One Century ago they Interpreted the law to apply only to white males, leaving out the Majority of women and non-Caucasians.  ( All Men were Created Equal and Not Mankind due to their own proclivities and racist sexists customs.) It also determined that others were Not human, leaving them at a disadvantage, under the Provisions of the United States Constitution and Bill of Rights, agreeing with Congress who for the most part wrote legislation allowing it until the mid Twentieth Century.
