How can court remove my name as a cosigner on a truck loan?

You can't -- without the borrower paying off his loan and him getting another without your name on it. But the bank will not simply take your name off the existing loan.

they cant. The other party need to refiance or the loaner needs to be nice and allow your name off

Won't happen, unfortunately.

Even if you took the other person to court, it all comes down to "who has the truck in their possession", and a court cannot remove someone off of a loan.

Best to have the other person take out their own loan for the remainder of the current loan, and "buy" the truck.
