Question:

How can i be reimbursed for lost time and material from another contractors' bad work slowing me down?

I run a flooring company, and am currently doing a large hotel(ceramic tile). The first floor concrete is in bad shape meaning humps and low spots. this has been mentionted to the concrete contractor and the general contractor numerous times. Small thing have been done to improve the problem but not near enough, and now its costing me alot of time and money in materials to get this job done. How can i go about being reminbursed for this lost time and material? If back bill the concrete company is the answer how might i go about that?

  1. I assume that your contract to do this work is through the General Contractor.  The only way you can go about this is to ask for more money from him.  Since you have no legal ties with the concrete sub, he does not have to pay you a penny.  The problem is that it sounds like you've already covered up the defective work, it will come down to how well you documented the defect in the concrete.  Since you've accepted the work (the condition of the concrete), you really have very little recourse.
