How can i break my lease agreement with no penalties and maybe get money back?

i live in a subdivision with a hoa, i have a neighbor who complaines about every thing , cant have quads visible,cant have trash cans where she can see them, a tree has fallen its been that way since ive moved in shes complaining about that , i now have 4 warnings from hoa these need to get resolved or im going to have to pay a fine i already had to get rid of one dog because she told my husband she was going to complain to hoa until they r gone i want out is that possible .

I'm sorry; but you got yourself into that situation when you and your husband signed the lease to live there and abide by the rules and regulations ...

That is why I'd NEVER live anywhere near a Homeowner's Association .

IF I was you; I'd just break the lease and MOVE .... send them payments on the balance of the lease  ..like $25 -$50 a month untilit is paid off .

Assuming you are not the property owner, there are two items to consider here.  You have certain terms you agreed to under contract with the owner of the property which are contained in your lease.  Separately, the property owner (your landlord) agreed to a set of "deed restrictions" by covenant when they purchased the property.  Those rules are set and enforced by the H.O.A.

Fines levied by the H.O.A would be against the owner of the property - your lease would determine if your landlord can then pass those fines on to you, or if they are considered breach of contract and give him recourse to terminate your lease and keep your deposit.

Bottom line, you really need to carefully read your lease, and you should have a copy of the HOA bylaws provided to you as well so you know what is and isn't a legitimate complaint by your neighbor.

obtain a copy of the hoa by laws and your lease agreement and see what avenue you can pursue....what your rights are and what you can do to compel the hoa to get the hag off your back
