How can i fight a speeding ticket in california? he pulled over two cars at once and was in front of me.?

i was driving on a two lane freeway going to long beach, ca from san pedro, ca. i was in the left lane changing into the right lane when a cop came out of a speed trap, pulled out in front of me and put on his lights to pull over the car in front of him. he then proceeded to stick his arm out the window and make me pull over, or at least so i thought. i was not going to flee from a cop, so pulled over. he ticketed the car in front of me first and then ticketed me. he said the car in front of me was going 70 and i was going 68 in a 45(i'm not absolutely sure about that). so first off, how is it possible that he radared me, if he pulled the car over in a different lane? also, i requested that i go to court in LA because i work out there and am rarely in san pedro where he wanted me to go to court. can that help me? i would just pay the ticket, but i plan on fighting the ticket because i can't afford to have any more points on my record. i've already gone to traffic school and 2nd offender traffic school. any suggestions as to how i can fight it? or what i can say in my defense?

  1. Pay the ticket.  You were speeding.  You should have thought about your inability to pay the ticket, and not being able to afford more points on your record before you decided to speed.  I would think that would be the responsible way to think.  (oops...did I say "responsible?)  I guess some people just never learn.  Pay the ticket.  You won't win this one, so in your defense, say you're guilty.


  2. The fact is..you where speeding and you are already in traffic school. seems to me that you need to learn to drive and slow down. I am sure there was other people speeding, but do you really think the officer can pull everybody over? Not to be mean, but you should have thought about that before you decided to speed. If you do not cool it..you are going to lose your drivers license.

    The above statement seems to speak for itself.

Court is in the jurisdiction where the crime was committed.  Another court has no authority.  Radar is not required but the cop may make a visual estimate based on his training.  In your case, he probably used the radar on one car and then evaluated the difference in the speed between the two.  You can defend any way you wish.  Plead not guilty and set a trial.  Cross examine the cop on his ability to identify you as the driver, or his ability to estimate speed, or whether it was really a public highway, or whether the state traffic engineer really fixed the speed limit, or the constitutionality of the speed law or anything else you wish.  Whether it works or not, no one can tell you but the judge.

  5. You are toast.  Pay the man and don't waste your time or money.  I feel your pain, but it won't matter to the judge.  Some states have a deal where you can pay extra and avoid the points, this may not be an option in your case with your record.  Good luck!
