i am black and my wife is mexican we just had a baby girl i want to get her over here with me how can i get her here legal?

    What Is a K-3 Visa?

    Spouses of U.S. citizens, and the spouse's children, can come to the United States on nonimmigrant visas (K-3 and K-4) and wait in the United States to complete the immigration process.

    In other words you can get her here legal but then continue the citizenship process after she gets here.  

    It will take between 9 months to 15 months depending on the amount of applications that are currently filed or any other special considerations you have.  By special considerations I mean if you don't meet the minimum income requirements to be able to support your wife by US government standards.  Or if you have some sort of legal issue that would prevent or delay the process.

  3. I am sorry and embarrassed to say this will take years. Just go to the State Department web site and fill out the forms. I am very sorry. Do you have the right to work in Mexico?  The instant American Citizen stuff is a cherished myth that ended more than a decade ago.

    It is actually easier to get her into the country before you are married. You can get 6 months on a fiance Visa instantly.

    You can sometimes apply at the US embassy in in Mexico City.

  4. You will have to get your wife a spousal visa. This will take some time.

    As far as the child is concerned you have three basic choices:

    1) Get the child a Mexican Passport as a Mexican citizen.

    2) Get the child an US Passport as a US citizen

    3) Get the child a US passport as a US citizen and a Mexican passport as a Mexican National.

    (Mexico does not allow dual citizenship)

    This is assuming you are a US citizen.


  5. Do a search on Yahoo for spouse visa and you'll find lots of answers, including the correct forms that you'll need.

    You need to register your daughter's birth w/ the US consulate in Mexico, if she was born there.  You can apply for a passport for her at the same time.  

    If she was born here and you're trying to get your wife "legal" you'll need to apply for a spouse visa.  Your wife will need to return to Mexico and apply there.  

    The color of your skin has no bearing on this.
