Question:

How can i protect my land from roadway construction easement or how do i write a proposal.?

this roadway will take up most of my front yard and driveway, much closer to my house, will take away my shade trees, flowers, bushes, traffic will be a hiway, speed up traffic, and 4 small children live on this road next door. there driveway and house will be about 10 feet from hiway. don't know where to turn or where to go on this, am very much against this construction, but don't seem to have a leg to stand on.

thanks for any help u can give me. this is a rural area, out of city limits, so am dealing with county, as there is a industrial plant coming in soon up the road from our road.

  1. You don't have a leg to stand on.  

    Did you know that this day would be coming.  Or has this whole construction of a road caught you by surprise.  They took my property and i had to change my garage to the side. I think you had some idea this was coming.


  2. Did the unimproved public right-of-way already exist or are they actually condemning a portion of your land?  If the ROW already exists, there is nothing you can do.  Your bushes, etc., are on the public land.  If they are actually taking land that (by deed) is private land owned by you, they can do so but only with compensation.

  3. They will say it is for the greater good of the community and claim eminent domain.  Not much you can do unless you can find an endangered species on your land.
