  1. Even if the witness sides with you that won't matter a whole lot.  Insurance companies access %10 responsiblity to anyone who has an accident.  Even if you didn't cause it.


  2. Assuming the witness is speaking up but not telling the truth that it was not your fault you will probably have to go off police reports (aka: estimated speeds, tire marks, etc). Also bring it up in court that the witness has a relationship with the other driver so it would benefit them to lie in there favor if that is the case. All else fails and they cant prove who did what they will probably put you both at fault.

You're being too vague about the accident.  If you hit them from behind, automatically, you are at fault, no questions ask.  If there were skid marks the officer who took the report could base the fault by the marks.  If the witness was someone who was with the other driver, there is a conflict of interest, they could lie for them and you don't have to allow that person as a witness.  You can also draw a diagram as to what happened (in your point of view).

Well, you prove you're not at fault, by showing that the damage to both cars, is consistant with YOUR story, not the other guy's story.  This assumes that the two of you, have two different stories.  If you both agree how the accident happened, then one of you isn't familiar with the "standards of fault".

    One caution - most people think they are not at fault, that the other guy is.  And they're not familiar with the "standards of fault".   So half of them, logically, are wrong, but firmly believe they are right.  

    You can always ask your agent for their opinion - your agent can apply the state specific standards to your situation.
