How can i put a lean on a builder that wont pay up????

i did some work for a builder but now he wont pay up and we didnt sign any contract since it was a one time thing so can i still put a lean on the house????

Lien laws vary from state to state.  You are probably out of luck, especially if you are not licensed and insured.

Second, no, the county will not record a lien on the property if there was no contract.

yes you can as long as you can prove you did the work. Contact lawyer. He will file lien with the county. It dosent cost much if you do it yourself, that is if you know how. I think it is under $50 LAwyer will cost you couple hundred. You put lien that will get his attention real quick.  Was the work on his house or commerical project. If was commerical project he could just bond the job and will take forever to get your money. Also send the owner a letter of intent to lien, you can get paid directly from the owner.

Yes, but you must act with a certain time limit.  Consult an attorney for the law in the state where you live.

Contracts don't have to be in writing unless it is a contract to PURCHASE REAL PROPERTY.  if you had a verbal agreement or a "handshake", that's as good as a contract, but of course it would be your word against theirs in court.  

you would have to take them to court to recover the money.  if you get a judgement against them, they will have pay, and it will go on their credit records, but no lean against their property.

Without a contract and notice to owner you are left with civil court.

When you do work for a builder you have to send a notice to owner to the actual owner of the building, you need to let them know that you are working on their property and if the person who hired you doesn't pay the owner will.

There is such a thing called 'mechanical lein' that can be placed on the house, if the owner refuses to pay for work that was done.  I do not know if it would work on a builder, but you can take him to small claims court.  Even if you didn't have a contract you still did the work.  Next time though, get it in writing.
